     There  are many laws which seek to regulate  behavior
involving  persons in situations of conflict of  interest.
Legislators may not participate in passing laws pertaining
to   their   major   financial   interests.     Regulative
administrators may not be on the payroll of the businesses
they are to regulate.   Businesses which are ostensibly in
competition with each  other  may not cooperate in setting
their prices. Citizens with special interest
in  a  defendant  may not sit on the  jury  hearing  the
defendant's case.

     Within  education there are a variety of interests or
purposes   being  served:    (1)    The  passing   on   of
information,  knowledge, skills;  (2)   The development of
new information, knowledge, skills;  (3)   The inculcation
of  certain  values,  attitudes,  perspectives,  modes  of
coping, codes of conduct, world views, rituals;  (4)   The
critical  examination of traditions as represented in  the
previous  items;   (5)   The certification  of  successful
fulfillment of the educational interests and purposes; (6)
The    certification    of   students'    abilities    and
accomplishments irrespective of how achieved.

     There  are  numerous ways in  which  educational
interests  and  purposes  conflict with each other:    (1)
Research diverts attention away from relating to students,
(2)     The   program  of  inculcation  and  of   critical
examination conflict with  each  other,   (3) Teachers can
not   be  without  bias  in  certifying  their  successful
fulfillment  of  their  own  educational responsibilities,
(4)     Certification  of  independent  student   learning
undermines  the market  for  educational  services,    (5)
Students'  desires  for  successful certification conflict
with   their  need  to  be  open  with  educators,     (6)
Educators'   desire  for  student  approval  and   support
conflicts with their desire to be open with students.

     The  improvement of education depends critically upon
a  public examination of the various kinds and degrees  of
conflict  of interest within educational institutions.
Only  as  those conflicts of interest are dealt  with  the
wisely  will  it be possible to deal wisely with the  most
persistent problems in education.  Thus the mitigation of
conflicts  of  interest should  be  a  high  priority  for
education,   the nation's single largest business/consumer
